Driver charged in fatal crash. Second Chesterfield man killed in area crash since Wednesday

DOVER TWP. -- After his discharge from Otsego Memorial Hospital (OMH) Monday afternoon the driver in Sunday's fatal crash was lodged in the Otsego County Jail and charged with one count of Operating While Intoxicated Causing Death.

Kevin Schneider, 38, Warren, was arraigned in 87th District Court, via a video arraignment from jail on the charge which carries a maximum penalty of 15-years in prison.

One of Schneider's four passengers, 38-year-old Kenneth Davis of Chesterfield, was killed when Schneider allegedly ran off the road at the intersection of Wilkinson and Marquardt roads.

Troopers from the Gaylord Michigan State Police (MSP) post were dispatched to the accident around 1:45 a.m. after Schneider reportedly took a curve in the road too fast.

A Sunday news release from the Gaylord MSP post said Davis was pronounced dead at the scene when Schneider lost control of the 2002 Cadillac Deville he was driving, drove off of the roadway and rolled over.

Davis was the second person from Chesterfield to have died in an area crash since Wednesday. Gary Thompson, 49, was killed Wednesday night west of Elmira when he allegedly failed to stop at the intersection of M-32 and US-131 and was struck by an oncoming tractor trailer.

According to the state police in addition to alcohol, speed and a lack of safety belt usage were contributing factors in Sunday’s crash. The news release stated Schneider, whose name was not released by authorities until after Monday's arraignment, was arrested at the scene for Operating While Intoxicated Causing Death.

Schneider and his three other passengers were transported to OMH by the Otsego County EMS/Rescue and admitted for injuries. The status of his passengers is currently not known.

Bond for the Warren man was set at $2,000 10-percent cash surety. Officials said they expected Schneider would meet bond conditions today (Monday). He has retained legal counsel from Gaylord attorney Brad Bensinger.

The crash remains under investigation and troopers were assisted by the Otsego County Fire Dept. and officers from Gaylord Police Dept.
