" It's not the judges we need to wory about, it's the police officers. "

" I agree with you concerning our present group of judges locally. My observations should be clarified to reflect a general concern over judicial discretion which occurred many years ago in this area. In addition, I believe that judges do make superficial and subjective assessments. They are human after all.
But otherwise I agree that we have a fine group of judges in this community. Some of the finest. "

" I have to disagree, I believe our judges are fair and would not discriminate against someone based on what they are wearing at court. I do think that a better attorney will help in the plea bargaining process or jury trial, but has nothing to do with the judges sentence. Judges have sentence guidelines which include the persons criminal history. If someone has a convictions for violent felonies in the past the judge may decide to use the maximum sentencing guidelines and if the person has never been in trouble the judge may use the minimum. I respect the judges in our community and although I disagree with thier views on drug crimes and property crimes, I still respect the job they do. "

CUTTY wrote on Aug 22, 2008 7:49 AM:

" Its interesting to note that wide disparity between sentences. Not only are police officers given discretion but judges and magistrates are as well. This is good but one wonders if there truly is "equal justice under the law", where one drunk driving offender gets probation while another gets 90 days in jail.
Many factors can account for this, including how much blood alcohol content was involved, was there any resistance to arrest etc.
However the appearance and demeanor of a defendant in a courtroom and the adequacy of their counsel also plays a role.
I pity the poor defendant who has both a bad wardrobe and inadequate counsel representing them. "

" Actually when the cops arrest someone for driving without insurance or on a suspended license the prosecutor pleas it down to impeding traffic if they get insurance or take care of the suspended license. And my understanding is the library and court get 90% of the fines, the police actually get around $15. "

" Good thing our police dept. is cracking down on those traffic impeders.
Will all of the money the city is taking in from the traffic impedeing fines, will they be able to reduce my property taxes? "
