New charges in passenger death

LIVINGSTON TWP. — The driver in a fatal Dover Township crash waived arraignment Thursday to additional charges filed by the Otsego County prosecutor’s office in the death of one passenger and serious injury of two others.

According to prosecutor Kyle Legel, in addition to the original charge of operating while intoxicated causing death, a 15-year felony, three new charges were filed against 38-year-old Kevin Schneider from Warren. Schneider’s passenger Kenneth Davis, a 38-year-old Chesterfield man, was killed when Schneider allegedly lost control of his 2002 Cadillac DeVille at a curve on Wilkinson Road near Marquardt Road during the early morning hours of Aug. 17.

According to Legel, Schneider was also charged with one count of homicide/manslaughter with a vehicle, a 15-year felony and two counts of operating while intoxicated causing serious injury, 5-year felonies. Two of Schneider’s passengers, John Davis, 38, Union Lake and Richard Fruitman, 44, Ferndale, reportedly sustained serious injuries and were transported to Otsego Memorial Hospital (OMH) and later transferred to other medical facilities for treatment of injuries. Craig Hanson, 37, Warren, was treated for injuries at OMH and released.

Legel said Schneider’s Gaylord attorney, Brad Bensinger, waived his client’s arraignment to the additional charges in 87th District Court and a preliminary exam is now scheduled for Oct. 23 at 1:30 p.m. Schneider, who was hospitalized at OMH for injuries from the crash, remains free on a $2,000 10-percent cash surety bond while awaiting his next court appearance.
